Bystanders Pushed Puffy To Floor During Shooting, Guard Says

Witness also testifies that Shyne shot toward ceiling, not into crowd

NEW YORK — A Club New York security guard testified Monday that she fell on top of Sean "Puffy" Combs as panicked bystanders knocked them both to the floor when shots rang out early in the morning on December 27, 1999.

"You had no choice but to go down. The whole crowd leaned into us," said the guard, Charise Myers. "I fell on top of Mr. Combs — other people fell on top of me."

Contradicting several prosecution witnesses, Myers also testified that Combs protégé Jamal "Shyne" Barrow, who is accused of shooting three bystanders, fired up toward the ceiling, not into the crowd. She said Combs did not have a gun during the shooting, but Shyne did.

And Myers identified Matthew "Scar" Allen, who argued with Combs before the shooting, as the man who escalated the dispute by throwing money at the rap mogul. Other witnesses have said that the money-thrower was someone in Allen's entourage.

After Allen threw the money, Shyne said, "F--- this sh--" and opened fire, according to Myers.

"I saw him firing a gun — maybe one or two shots in an upward direction, towards the ceiling," Myers said.

Combs looked shocked and frightened during the shooting, according to Myers.

Combs' lawyer, Johnnie Cochran, asked Myers if she could see Puffy's hands during the shooting.

"His hands were on the floor, like the rest of him," Myers said.

She echoed other witnesses' accounts of Allen screaming at Combs just before the shooting. "Who the f--- do you think you are?" Allen shouted, according to Myers. "I'll see you. I'll see you."

In cross-examination, prosecutor Matthew Bogdanos reminded Myers of grand jury testimony in which she said that while Shyne appeared to be firing up, people in the crowd were jostling him as he pulled the trigger, possibly throwing off his aim.

Myers acknowledged having said that. She added that she only saw Shyne fire two shots and that she heard additional shots, which could have come from Shyne or from someone else, while she was on the floor.

Shyne is charged with attempted murder, while Combs is accused of brandishing a gun and firing it into the ceiling.

Last week, another witness, clubgoer Christopher Chambers, said Combs ducked when the shooting began, but didn't say that the rap mogul was ever flat on the floor (see [article id="1440916"]"Puffy Ducked And Didn't Shoot At Club New York, Witness Says"[/article]).

Later Monday, Arhemia Fida-I, a friend of Tarnisha Smith - one of four witnesses who said Combs had a gun at the club - gave testimony that seemed intended to cast doubt on Smith's story.

Friends of at least two other prosecution witnesses, Natania Reuben and Julius Jones, are expected to give testimony challenging their

credibility as Combs' defense team continues its case.
