August 28 [10:00 EDT] -- A lawyer for Depeche Mode frontman Dave Gahan is due in Beverly Hills Municipal Court Thursday, to request that the court dismiss charges against the singer of possessing, and being under the influence of cocaine.

Last May, Gahan completed a year-long drug rehab program, which began after his cocaine and heroin overdose at a Hollywood hotel in early 1996.

We're told Depeche Mode has no tour plans, since Gahan feels he might slip back into addiction on the road.
