A man who got into [article id="1562284"]a scuffle with Pete Wentz[/article] last summer at a Spin magazine party is suing the Fall Out Boy bassist and the fight's venue, Schuba's Tavern in Chicago, seeking unspecified damages.

In the suit, Andy Kallas alleges that he suffered "serious injuries to his head, mouth and face" after an unprovoked attack by Wentz and as many as 10 other individuals.

Wentz has a different view of the incident, and he responded exclusively to MTV News on the matter. "This lawsuit is entirely without merit and will be vigorously defended," Wentz said via e-mail. "This is another in a long line of frivolous lawsuits that are filed against celebrities each year from individuals seeking a quick payoff when there is absolutely no justification for the claim."

When we first covered the story back in June, one Schuba's patron said Kallas was "calling Pete a sell-out, asking him, 'Where's [fiancee] Ashlee [Simpson]?' and making fun of his hoodie."

Wentz himself said that he only punched Kallas because the man had grabbed him, and that he was acting in self-defense. "We get heckled onstage all the time, and while I'm a jerk, I'm not the kind of person who would ever lash out at someone simply over this," Wentz told us at the time.

The scrap at Schuba's was the second Wentz was involved in last year. In January 2007, he [article id="1549582"]battled a security guard[/article] at the Sunshine Theatre in Albuquerque, New Mexico, after the guard allegedly shoved a member of FOB's security team. No charges were filed in that incident.
