John Guerra, the man Eminem allegedly assaulted after witnessing him kissing his wife, Kimberly Mathers, in the parking lot of a Warren, Michigan bar, has filed a civil suit against the rapper for assault and intentional infliction of emotional distress.
Guerra filed the suit on June 9 in Macomb County Circuit Court and is seeking at least $25,000 in damages, the monetary threshold for a case to reach the court, although a final amount -- if awarded -- would be determined by a jury. Speaking to media on Friday outside the Macomb County courthouse, Guerra recalled how shortly after Hot Rocks Café closed on Sunday, June 4, Kimberly Mathers hugged and kissed three or four friends in the parking lot, including Guerra. "Kim and I were embracing," Guerra said. "She gave me a kiss and the next thing I hear is, 'Gun! Gun! Gun!'" Guerra said he didn't recognize Eminem at first when he approached, carrying a pistol at his side. The rapper then allegedly pointed the pistol
a few inches from Guerra's face and repeatedly threatened to kill him. "I truly believe he was going to kill me. He was in such a rage," Guerra said. During the struggle between the two, Guerra said he was struck several times in the head and face before fleeing the scene and couldn't recall if anyone tried to intervene in the fight.
I actually lived through a nightmare and survived a nightmare," he added. "I'm still shaking. I have a hard time sleeping.
Eminem was taken into custody by authorities arriving on the scene and has subsequently been charged with assault with a dangerous weapon and for carrying a concealed weapon without a license (see [article id="1428611"]"Eminem To Face Weapons, Assault Charges"[/article]).
In neighboring Oakland County, Eminem faces additional charges of carrying a concealed weapon and brandishing a weapon in public after exchanging words with an associate of the Insane Clown Posse at a car-audio shop
a few hours before the Hot Rocks Café skirmish (see [article id="1428608"]"Eminem Charged In Altercation With ICP Employee"[/article]).
