However, in a statement to MTV News, her rep explains that while the matter is still being investigated, he believes Lohan will eventually be found innocent.
"While some of the facts are still being gathered, it appears that this is much ado about nothing. We are confident this matter will be cleared up in the coming weeks and the claims being made against Lindsay will be proven untrue," her rep noted in the statement.
That statement may be referring to surveillance footage that exists of the incident. According to reports it shows the entire event and the moments after. Officials reportedly reviewed the footage and the accident appears to be so minor that they were unable to judge whether Lindsay had even touched the alleged victim, who has since been identified as Jose Rodriguez, a Manhattan chef.
The NYPD has confirmed to MTV News that there is footage but couldn't provide further details regarding the nature of it. A rep for the Dream Hotel could not comment on any reports, as it is an ongoing police matter. Alcohol is not believed to have played a part in the accident.
Earlier on Wednesday, it was confirmed that Lohan was pulling into a parking garage of the hotel in her Porsche Cayenne around 2 a.m. at a low speed when she hit the knee of a thirtysomething man walking by.
Shortly after, Lohan was arrested when she surfaced from the Dream Hotel around 2:30 a.m. The police spokesperson said Lohan was booked for a misdemeanor charge of leaving the scene of an accident causing injury and was released with a desk appearance ticket, which does not require posting bail. She was ordered to return for a hearing on the matter at a later date.
The police spokesperson said the victim in the case complained of a knee injury and was transported to a local hospital. "With this being a non-fatal accident, it was within the criteria of a desk appearance ticket," the police source explained.
The accident could pose more problems for the actress as it could prompt an investigation in Los Angeles of a possible probation violation from Lohan's 2011 jewelry theft case. The conditions of probation from that case require that Lohan obey all laws. Lohan is on informal probation in the jewelry case until May 2014.
The news of her latest legal woe comes just as Lohan is also plotting a return to acting. She has wrapped up roles in the Lifetime biopic of "Liz & Dick" and "The Canyons." She will also make a cameo in "Scary Movie 5" alongside Charlie Sheen.
