Mum has been the word from both Tom Cruise and Katie Holmes in the wake of her surprise divorce petition
last week to end her five-year marriage to the box-office superstar. While Cruise, 50, was said to feel blindsided and devastated by the divorce proceedings, Holmes has reportedly been prepping for a life without her former high school crush for several months.

Amid reports of a solo New York apartment and an elaborate plan to switch out cell phones to coincide with the divorce proceedings, Holmes, 33, made one of her first public outings on Wednesday. Running errands with daughter Suri, 6, in New York, Holmes was ambushed by a reporter from the New York Daily News while shopping at Whole Foods. "I'm alright," she told the paper. "Thank you." Cruise, meanwhile, had planned to spend his July 3 birthday with his third wife and Suri, but instead the "Oblivion" star spent it alone
.

Holmes noted in the divorce filing that her relationship with Cruise had been "irretrievably" broken for more than six months. This news comes as she was spotted with Cruise in Iceland only weeks before she filed for divorce. In the same legal documents, Holmes added that she and her husband had been living in New York City for at least two years prior to the split. She is looking to keep divorce proceedings in the Big Apple.

On Monday, Holmes fired her publicist and re-signed with BWR Public Relations, the firm she had been with prior to her relationship with Cruise.

Sources told Us Magazine that Holmes is trying to get her career back on track
as it had been heavily controlled by Cruise, who wouldn't allow her to do films that included "sexually compromising scenes, largely because the Scientology folks objected."

An unnamed source told Us, "She's been miserable for a long time, but the last couple of weeks, she's been happy — like she's been set free ... Every move she made and everything she did was controlled ... She felt like she was in Rosemary's Baby," in reference to the 1968 horror flick in which an aspiring young actress is tricked into bearing a child for her husband's satanic cult.

With a divorce attorney already on tap, Holmes appears to be gearing up for what could be a contentious custody battle over Suri.

But, contrary to some reports earlier this week, Holmes' lawyer denied reports that the actress is seeking an emergency hearing on custody and child support. "Other than her action for divorce, the only pending application filed by Ms. Holmes remains her request for an anonymous caption," lawyer Jonathan Wolfe said about the anonymously filed papers in the divorce case. Holmes has asked for sole legal custody of Suri.
