That smell coming from the Chicago River on Friday? For Chicagoans, it was the smell of victory.
The Dave Matthews Band have settled a civil lawsuit filed in August by the state of Illinois for dumping 800 pounds of human waste from their tour bus into the river and hitting a tour boat passing below, The Associated Press reports (see "Dave Matthews Band Sued For Stinking Up Chicago River").
The suit alleged the band violated state water pollution and public nuisance laws, and the DMB were charged with two misdemeanor counts of reckless conduct and discharge of contaminants to cause water pollution. They have agreed to pay $200,000 to an environmental fund and take measures to ensure the incident will not happen again, the Illinois attorney general's office said Friday (April 29).
"Although the bandmembers weren't on the bus when the incident took place, we have always said that if it was our bus we would take responsibility for what happened, and that is exactly what we're doing today," Dave Matthews Band spokesperson John Vlautin told the AP.
Although this closes one chapter of the case, other action is still pending. In February, the band was slapped with a lawsuit from Mercury Skyline Yacht Charters, owners of the boat that allegedly had the human waste dumped on its passengers (see "Dave Matthews Band Hit With Suit #3 Over Dumping #1 and #2"). The company, which is seeking between $50,000 and $5 million in damages, claims the incident affected its ability to generate business.
Last month, Stefan Wohl, the band's bus driver, pleaded guilty to charges of reckless conduct and discharging contaminates to cause water pollution and was sentenced to 18 months of probation and 150 hours of community service.
