Courtney Love was hospitalized in New York on Friday (July 9) after the singer failed to appear in a Los Angeles court for her scheduled arraignment on an assault charge prompting the judge in the case to issue a bench warrant.
Love, who turned 40 on Friday, was supposed to have been in court to enter a plea on a felony charge of assault with a deadly weapon for allegedly attacking a woman with a bottle and a flashlight on April 25 (see "Courtney Love Turns Herself In To Face Assault Charge"). Bail had been previously set at $55,000, based on Love's prior arrest record and the fact that the crime was allegedly committed while the singer was released from custody on bail from another charge. However, Judge Dennis E. Mulcahy revoked her bail, saying that she forfeited it by not being present with "no legal excuse," and set a new bail of $150,000.
"She's in violation," Mulcahy said in court. "Why should I treat her any differently than anyone else that fails to appear in this courtroom?"
At the time, Love's lawyer Michael Rosenstein argued that it was a simple matter of confusion on Love's part, but Mulcahy responded, "I have not heard anything that counts anywhere near for cause for failure to appear," Mulcahy said.
While that courtroom drama was unfolding in Los Angeles, Love was facing a medical drama on the other side of the country. The singer was later taken from her New York apartment to Bellevue Hospital Friday afternoon for what her lawyer later called "a gynecological medical condition." Love was handcuffed and placed on a stretcher during her trip to the hospital after reportedly refusing medical treatment.
Police were reportedly called to Love's apartment on Friday afternoon after complaints that the singer was throwing bottles from her fourth floor window. Police could not determine who had thrown the bottles and took no action at the time, but emergency medical personnel reportedly returned at approximately 5 o'clock that afternoon after receiving a 911 call from Love's home reporting a miscarriage.
Love's attorney told reporters that the incident was "not a suicide attempt, not drug-related, not drug-overdose-related."
During Friday's court appearance, Rosenstein had said that he planned to have Love back in Los Angeles to enter a plea by Thursday, but now the singer's medical condition -- as well as the outstanding bench warrant issued against her -- would seem to change that timetable. "Any police agency can arrest her at any time now," Jane Robison from the district attorney's office said.
The case is one of four that Love is currently facing. She's currently awaiting sentencing on a misdemeanor drug charge stemming from October, to which she pleaded guilty as part of a plea agreement that could send her to rehab instead of jail (see "Courtney Enters Plea Agreement In Hopes Of Getting Rehab"). She's facing a felony drug case from the same incident. She's due back in court on July 15 for the felony drug charge, and on July 16 for sentencing on the misdemeanor drug charge.
It was for the drug possession charge, however, that Love had already racked up at least one other failure to appear (see "Courtney Love Misses Court Date, Cites 'Security Concerns' "), causing the judge in that case to issue a bench warrant for her arrest. Her attorney, William Genego, told the court at the time that Love hadn't shown up because of "security concerns."
Love also has an assault case waiting for her in New York. Last month she showed up more than five hours late for a hearing on charges of assault and reckless endangerment for allegedly hitting a fan with a microphone stand (see "Courtney Love Says Mic-Stand Accuser Is Motivated By Money"). She's due back in court on that charge on September 7.
Due to all these legal problems, Love's summer tour plans were compromised, and she had to postpone the trek (see "Courtney Love Tour Derailed By Singer's Legal Woes"). She since has started rescheduling the dates, starting with a headlining gig at the Fuji Festival in Japan on August 1.
