An Aerosmith fan has filed a lawsuit against the band, alleging he suffered
permanent hearing loss after an October 1997 show at the Concord Pavilion in Concord,
Calif., according to a report by the Associated Press. The fan, Mark Nieto, also
named the city-owned venue in the suit, claiming he was "not aware of warnings for ear
damage" prior to attending the show during the band's Nine Lives tour. City
Attorney Richard Doyle seemed taken aback by the lawsuit, according to the report.
"We'll look into it, but this is a new one," Doyle said. "This is a first."
