Adam Horovitz and Michael Diamond of the Beastie Boys are in trial with energy drink company Monster after suing them for more than $2 million for using the band's music in a promotional video for a snowboarding competition. The late Adam Yauch stated clearly in his will: "In no event may my image or name or any music or any artistic property created by me be used for advertising purposes." Monster's lawyer said the use of the band's music was a mistake and the company should only pay $125,000 for the five weeks that the video was online.
