<b>Alicia Keys</b> is becoming a mom &#8212; Mommy Martian, that is &#8212; in an upcoming episode of "The Backyardigans" called "Mission to Mars." She is voicing the green alien who joins the gang in a musical space adventure, while her real-life niece, Shakyra Lipscomb, plays baby Martian Boinga. Keys also contributes an original song, "Almost Everything Is Boinga Here." The special episode airs October 9 on Nick Jr., exactly one week before the second season of the animated children's show begins. "Mission to Mars" will be released as a DVD on October 10. ...
</p><p><b>Cameron Diaz</b> is accusing a photographer of assault with a deadly weapon after he allegedly drove his car at her and boyfriend <b>Justin Timberlake</b>, <i>The Associated Press</i> reports. The couple were leaving a friend's house in Hollywood early Wednesday morning (September 20) when a photographer jumped out of the bushes and tried to photograph them. Diaz and Timberlake then chased after the man, who got into his car and drove at them. No one has been arrested, but an investigation is under way. ...
</p><p><b>Lance Bass</b> is writing a tell-all book. "With <b>'NSYNC</b>, all my experience with space travel and Russia and the whole coming out thing, I have a lot to say, so I decided to go ahead and start writing it down," he told "Access Hollywood." ... <b>Beyonc&#233;</b> has been nominated for four Music of Black Origin awards, including Best Song, Best Video, Best R&B (artist) and Best International Female. ...
</p><p>A court order barring the "Rock Star: Supernova" band (featuring <b>Tommy Lee</b>, <b>Jason Newsted</b>, <b>Gilby Clarke</b> and now vocalist <b>Lukas Rossi</b>) from using the moniker <b>Supernova</b> has forced the act to amend its name to, er, <b>Rock Star: Supernova</b>, in deference to a California band that already holds the rights to the name. According to <i>Reuters,</i> an Epic Records spokesperson confirmed the altered name. The label will release the band's debut LP on November 21, and two tracks &#8212; "It's All Love" and "Be Yourself &amp; 5 Other Cliches" &#8212; are available for download. Rock Star: Supernova will launch a 28-city North American tour with the <b>Panic Channel</b> (which features the show's co-host <b>Dave Navarro</b>) in Las Vegas on New Year's Eve. ...
</p><p><b>Ashanti</b> has settled a lawsuit brought by her first producer, Genard Parker, after just one day in court. According to <I>AP,</i> the parties would not discuss whether any money changed hands in order to end the dispute on Tuesday, but Parker, who helped the singer record some demos at his apartment when she was 16, said he was happy it was over. Last year, a jury ordered Ashanti to pay Parker $630,000 over claims that she broke a contract with him, but a judge later rejected all but $50,000 of the award. Parker was granted a new trial, in which he'd been seeking $2.3 million. ... The release of <b>Pitbull</b>'s second studio album, <i>El Mariel,</i> has been moved to October 31. ...
</p><p><b>Benzino</b> says he's far from done with the publishing world. He and fellow <i>Source</i> founder Dave Mays &#8212; who both lost control and ownership of the publication several months ago &#8212; have teamed up with former Vibe Editor-in-Chief Mimi Vald&#233;s to launch a new magazine, <i>Hip Hop Weekly.</i> It's slated to hit newsstands October 16. ... </p><p><b>George Lucas</b> is donating a whopping $175 million to his alma mater, the University of Southern California, <i>AP</i> reports. The Lucasfilm Foundation gift is the largest donation the school has ever received, and $75 million of it will go toward construction of a building for the institution's cinema school. Lucas' gift was announced Tuesday, shortly after the Tournament of Roses in Pasadena named the "Star Wars" director as the grand marshal of next year's Rose Parade. His duties will include tossing the coin before the 93rd Rose Bowl Game on January 1. ... <b>Angelina Jolie</b> and <b>Brad Pitt</b> are up to some new philanthropic efforts of their own. </p><p><b>Jim Uhls</b>, the man who adapted the "unadaptable" <b>Chuck Palahniuk</b> novel "Fight Club," has been hired to turn <b>Johnny Depp</b> into an Indiana Jones-like character. The <I>Los Angeles Times</i> reports that Uhls is working on an adaptation of the graphic novel series "Rex Mundi," that Depp plans to star in and produce through his Infinitum Nihil (Infinite Nothing) production company. Depp would play a pathologist investigating the mysterious death of the priest who found him as an orphan in an alternate-reality 1933, in which the Reformation never happened, the Inquisition is still in full swing and Europe remains dominated by the Catholic Church (got all that?). Uhls called the story a "noir-ish 'Raiders of the Lost Ark,' " complete with murders, a mystery and a massive biblical conspiracy uncovered by Depp's character. ...

"Kate has a unique position as a true fashion icon and I look forward to helping develop Kate Moss for Topshop into a global brand," Topshop owner Sir Philip Green said in a statement to <i>Reuters.</i> The line is expected to launch in spring/summer 2007. ... <b>Godsmack</b> and <b>Breaking Benjamin</b> will be teaming up next month for a 25-date U.S. run. </p><p><b>Diddy</b> spoke to 750 students at Philadelphia's Benjamin Franklin High School on Tuesday (September 19), telling them to stay in school and work hard, according to <i>The Associated Press.</i> "Take responsibility for your future. No excuses!" he told the students at the school, which is planning to use his message as part of an anti-truancy effort. Later in the day, he visited Winston Middle School in Baltimore and held a press conference at the Baltimore Hyatt Regency to promote his new album, <i>Press Play,</i> <i>Baltimore Business Journal</i> reports. Singer <b>Greg Dulli</b> posted the news on his Web site, saying that the group is prepping to cut two new tracks for an upcoming Rhino Records career retrospective titled <I>Unbreakable.</I> ... The reconstituted <b>INXS</b> are no longer with Epic Records in North America. The group, which recruited new frontman <b>J.D. Fortune</b> via the first season of the CBS reality series "Rock Star," sold approximately 375,000 copies of its 2005 album <i>Switch,</i> according to SoundScan. ... The youngest son of famed "The Lord of the Rings" author <b>J.R.R. Tolkien</b>, Christopher Tolkien, is wrapping up work on one of his father's most famous unfinished works. Christopher Tolkien has spent 30 years editing together "The Children of Hurin," a novel his father started in 1918 but abandoned without finishing, BBC News reported. <title><![CDATA[Supernova File Injunction Against Tommy Lee's 'Rock Star: Supernova']]></title>

The members of Orange County, California, punk trio Supernova filed for a preliminary injunction Friday (August 11) in San Diego's U.S. District Court against CBS Broadcasting, Mark Burnett Productions and Tommy Lee, Jason Newsted and Gilby Clarke &#8212; the three future members of the band searching for a lead singer on the show "Rock Star: Supernova" &#8212; which seeks to halt the act from performing or recording under the name "Supernova" if they fail to change or add any words to the moniker.
</p><p>The filing follows a suit the original Supernova &#8212; bassist Art Mitchell, drummer Dave Collins and guitarist Jodey Lawrence &#8212; filed against the show's producers in late June, which alleged trademark infringement (see <a href="/news/articles/1536107/20060711/supernova_california_.jhtml">"Supernova Sue 'Rock Star: Supernova' Producers, Bandmembers"</a>). That suit seeks a jury trial, as well as the destruction of all "labels, signs, prints, packages, wrappers, containers, advertisements, electronic media and other materials bearing the Supernova mark."
</p><p>The original Supernova, who first formed in 1989 and have released four studio albums, claim that the suit's defendants intend to illegally use the Supernova name (which they say is taken) and trademark it. The group contacted the show's producers upon learning of the proposed name for the reality-television series, and the two sides have been in negotiations since before the June lawsuit's filing. With those negotiations at a standstill, the band decided to take additional legal action to protect its moniker.
</p><p>"Our client has taken legal action in order to preserve its rights to the name the band has worked so long and hard to establish," said Supernova's attorney, John Mizhir Jr. "We tried to settle the matter quickly and fairly, but after lengthy negotiations with CBS, Mark Burnett Productions and others, they left us with no options but to seek the preliminary injunction."
</p><p>The lawsuit claims that "Rock Star" producers willingly ignored the fact that the Supernova name was and still is in use, and therefore unavailable. The suit also alleges that "individuals within defendants' own organizations informed defendants of plaintiff's rights in the Supernova mark" and that illegal use of the Supernova name will cut into the original Supernova's future income by interfering "with plaintiff's business relationships" or causing them to lose merchandising deals and offers to perform.
</p><p>A hearing on the matter should be scheduled within the next 28 days; "Rock Star: Supernova" is scheduled to air through September 27. If a judge rules in the band's favor, the producers may have to come up with a different name for the show's in-the-making rock outfit.
</p><p>Calls to CBS for comment had not been returned at press time.

Nine days before the July 5 broadcast premiere of Mark Burnett's "Rock Star: Supernova" on CBS, the three members of Orange County, California, punk trio Supernova &#8212; who formed back in 1989 and released four albums, including 2000's <i>Pop as a Weapon</i> &#8212; filed a lawsuit against the show's producers, charging trademark infringement.
</p><p>The lawsuit, filed in federal court in San Diego, names Mark Burnett Productions, Rockstar Entertainment Inc. and CBS Broadcasting as defendants, along with Tommy Lee, Jason Newsted and Gilby Clarke &#8212; the three future members of the group this season's "Rock Star" is supposed to spawn and endow with a lead singer. After someone's chosen to front the band, the foursome will eventually record and release fresh material before touring the nation, all under the Supernova moniker (see <a href="/news/articles/1535219/20060627/supernova_california_.jhtml">"Supernova To Tommy Lee's 'New' Supernova: Hey, That's Our Name!"</a>).
</p><p>The suit filed by the original Supernova &#8212; bassist Art Mitchell, drummer Dave Collins and guitarist Jodey Lawrence, who joined the band in 1994 &#8212; seeks a jury trial, as well as the destruction of all "labels, signs, prints, packages, wrappers, containers, advertisements, electronic media and other materials bearing the Supernova mark."
</p><p>The band also wants the show's producers to "publish clarifying statements that [the show is] not associated with [the punk band]," and is seeking punitive and compensatory damages, attorneys fees and the "profits and all damages sustained by [the band] due to [the] misuse of plaintiff's Supernova mark."
</p><p>In addition, the filing requests that the show's producers be prohibited from trademarking the Supernova name; the suit claims seven applications have been filed thus far for the band name, and another two for "Rock Star: Supernova."
</p><p>Supernova, who have booked several live gigs for August and are in the midst of recording an album they'd like to release before year's end, claim in the suit that the "Rock Star" producers willingly ignored the fact that the Supernova name was and still is in use, and therefore, unavailable. The suit further alleges that "individuals within defendants' own organizations informed defendants of plaintiff's rights in the Supernova mark."
</p><p>Perhaps the strongest bit of evidence supporting that claim comes from Butch Walker, who the show's producers recruited to co-write and produce the inaugural offering from the other, still-singer-less Supernova. In a MySpace message dated May 11, provided as an exhibit within the filing, Walker wrote, "I can't believe those dudes chose your name. For the record, I tried to talk them out of it. I told them I had a CD by a band from back in the day called Supernova and they were retarded for [using the name]. They didn't listen. Good on ya for making a stink about it."
</p><p>The Walker correspondence, according to the suit, "clearly illustrates defendants' bad faith intent to willfully infringe plaintiff's Supernova mark." Upon learning that the show's producers had decided on Supernova as the name for the band anchored by Lee, Clarke and Newsted, the original band "demanded, and continues to demand, that defendants cease all such infringing uses" of the name. But, "defendants continue to knowingly and deliberately infringe" on Supernova's rights, which "has caused, and is likely to continue to cause, confusion and mistake among consumers as to source, sponsorship, and approval of defendants' goods."
</p><p>In short, that passage says the original Supernova are concerned that people seeking their albums and merchandise might purchase the newer band's instead.
</p><p>The documents further allege that the producers' use of the Supernova name will cut into the original Supernova's future income, as it will intentionally interfere "with plaintiff's business relationships," thus causing the band to lose "prospective economic damages," such as merchandising deals and offers to perform.
</p><p>Calls to CBS for comment were not returned by press time. Likewise, the original Supernova's attorney, John Mizhir, could not be reached for comment.

Bassist Art Mitchell isn't sure what to make of the upcoming second season of "Rock Star," the CBS reality-television hit that paired J.D. Fortune with a frontman-less INXS last summer.
</p><p>Next month, when "Rock Star: Supernova" hits the airwaves, M&#246;tley Cr&#252;e's Tommy Lee, Voivod/ ex-Metallica bassist Jason Newsted and former Guns N' Roses guitarist Gilby Clarke will band together to find a singer for their new supergroup: Supernova (see <a href="/news/articles/1534239/20060613/metallica.jhtml">"Jason Newsted Says Frantic Pace Of 'Rock Star: Supernova' Is 'Asking For Miracles' "</a>).
</p><p>The problem, Mitchell said, is he's been in a band with the same name for nearly 20 years.
</p><p>The Orange County, California, punk trio, who are still together -- "We definitely put the spaceship in neutral, but we never called it quits," he said -- have four shows booked for July and August. In the past, they performed at two Warped Tours and released three albums, most recently 2002's <i>Pop as a Weapon.</i> Supernova are perhaps best-known for the tune "Chewbacca," which appeared in Kevin Smith's film "Clerks."
</p><p>"It's like when you're a little kid and the bully down the street steals something from you and you don't do anything about it," Mitchell said. "But we're going to go kick some butt, dude. They probably figured we're clerks, but our drummer, Dave [Collins], is a lawyer."
</p><p>Although the Web site <i>All Music Guide</i> lists three artists bearing that name &#8212; a Chilean rock outfit and a jazz band as well as Mitchell's group &#8212; Collins claims his group legally owns the name, and they hired attorneys to respond to CBS in the form of a cease-and-desist letter.
</p><p>"You can't just waltz up and use our name," Collins said last week. "We're willing to fight for our name, our band. We have trademark rights to the name and we can prove those rights."
</p><p>Two weeks ago, the members of Supernova met with the "Rock Star" producers for a face-to-face chat, and the band hopes to schedule a second sit-down this week. Neither side has taken serious legal action yet, according to Supernova's lawyer, John Mizhir. And Mizhir said it might not get to that point: "There are a lot of ways to skin a cat and resolve an issue, and maybe we can come to [a resolution] that works for everyone."
</p><p>Mitchell, though, said that ultimately Supernova would like to keep its name and not be associated with a bunch of "washed-up metalheads," as that could confuse his band's fans.
</p><p>"How do two bands in pretty much the same genre, with the exact same name, who're both recording, play on the same planet?" he said, adding that Supernova have been recording and hope to release new music this fall.
</p><p>Supernova's members say they're not certain whether the producers of "Rock Star" researched the name, but Collins said his band isn't hard to find. A few years ago, when the <i>Star Wars</i> character Chewbacca was presented with the Lifetime Achievement Award at the MTV Movie Awards, the show's producers contacted the group to seek permission to use their track.
