<B>R. Kelly</B> appeared in a Chicago court Friday (December 16) to once again try to get the child-pornography charges against him dismissed. His attorneys argued that the prosecutors' phrasing that the singer "knew or should have known" that the girl was underage was contradictory, vague and unconstitutional. They'll get to make the argument about the wording, which, the state attorney's office said, is used in "all kinds of statutes," during a hearing scheduled for February 10. ...
</p><p>With barely enough time to recover after being voted world's worst dog owner by readers of <I>New York Dog</I> and <I>Hollywood Dog</I> magazines, <B>Paris Hilton</B> has topped PETA's worst-dressed list, thanks to her fondness for wearing fur. "Now we know what happens to all of Paris Hilton's cast-off pets," PETA writes. "I started this project out of the great respect I have for the courage and service of the rescue workers," Cruise told the crowd. "When I started this project, it was because I was in a position where I knew that I could help. It wasn't just about wanting to, but knowing I could, so I knew I had to do it." The controversial "detoxification" is based on Scientology principles, not scientific ones, and the method of flushing poisons from the rescue workers' bodies involves an intense regimen of jogging, sauna and ingesting oils and high doses of niacin. <title><![CDATA[Alicia Keys Scores Third <I>Billboard</I> #1 With <I>Unplugged</I>]]></title>

Soulful ivory-tickler Alicia Keys has released just three albums over the course of her career &#8212; the most recent, <i>Unplugged,</i> was recorded three months ago during the singer/songwriter's intimate set at the Brooklyn Academy of Music. Featuring duets with Common, Mos Def, Damian Marley and Maroon 5's Adam Levine, the LP hit stores last week and, according to the latest SoundScan figures, surpasses Canadian rockers Nickelback to open atop <i>Billboard</i>'s albums sales chart.
</p><p>For Keys, <i>Unplugged</i>'s chart-topping finish continues a pattern. She's now three-for-three when it comes to #1 debuts.
</p><p>Back in 2003, Keys' <i>The Diary of Alicia Keys</i> opened on top with more than 618,000 in sales, and her debut, 2001's <i>Songs in A Minor,</i> also took <i>Billboard</i>'s blue ribbon with 236,000 scans. Which brings us to <i>Unplugged.</i> With sales of close to 196,000, the LP outsold last week's retail kings, Nickelback, by over 25,000 copies &#8212; dropping the Chad Kroeger-led quartet's <i>All The Right Reasons</i> to #2.
</p><p>Keys' offering was one of just three new releases to creep into <i>Billboard</i>'s top 10, bucking the recent trend of dominating debuts. Southern California honky-tonker Gary Allan's <i>Tough All Over</i> opens at #3 with sales falling just shy of the 100,000 mark, while comeback kid Ricky Martin's <i>Life</i> assumes the #6 slot with sales for his disc coming in at nearly 73,000. The Black Eyed Peas surge ahead five chart positions to #4 with close to 90,000 copies of <i>Monkey Business</i> scanned, followed at #5 by Kanye West's <i>Late Registration</i> with 83,000 copies moved.
</p><p>Sheryl Crow's <i>Wildflower</i> slips two rungs to #7 with 59,000 scans, just ahead of eighth-place finisher Twista's <i>The Day After</i> and Gretchen Wilson's <I>All Jacked Up,</I> in at #9. Young Jeezy rounds out the big 10 thanks to over 54,000 scans of his disc, <I>Let's Get It: Thug Motivation 101.</i> Two albums from last week's top-10 took something of a week-two dive on the chart: Fiona Apple's <i>Extraordinary Machine</i> falls from #7 to #14 with over 48,000 scans and Franz Ferdinand's <i>You Could Have It So Much Better</i> plummets 19 spots to #27 with sales of nearly 35,000.
</p><p>After Alicia, Gary and Ricky, the biggest debut showing was turned in by Story of the Year, whose <i>In the Wake of Determination</i> opens at #19 on the chart with nearly 42,000 scans. Sevendust's <i>Next</i> follows at #20 with 41,000 copies sold. Danger Doom's <I>The Mouse and the Mask</i> surfaces at #41 with sales nearing 25,000, followed by Dolly Parton's <i>Those Were the Days</i> at #48 (over 21,000) and British vocalist/pianist Jamie Cullum's <i>Catching Tales</i> at #49 (nearly 21,000).
</p><p>Dru Hill's <i>Hits</i> collection opens at #71 with 15,000 plus scans, while the collaborative Roadrunner United project, <i>The All-Star Sessions,</i> finished at #76 with close to 15,000 copies sold. Warren G neared 15,000 scans with his latest LP, <i>In the Mid-Nite Hour,</i> to claim the chart's #79, and Default's <i>One Thing Remains</i> debuts at #89 with close to 14,000 scans.
</p><p><b>Another <i>One</i></b>
On October 11, Frankie J's <i>The One,</i> which is edging closer and closer to platinum status, was reissued as an expanded DualDisc, with Frankie's soulful take on Extreme's "More Than Words" as well as three other bonus tracks &#8212; one being "Suga Suga," a collaborative tune featuring rapper Baby Bash. The disc also contains video footage of Frankie on the road along with some of his music videos. Well it seems as though all those extras were enough to get some of the J-Man's fans to fork over more cash, as <i>The One</i> leaps from the chart's #175 this week to #84. The album experienced a 98 percent retail spike, amounting to close to 14,000 in sales. <i>The One</i> was originally released in March.
</p><p><b>"Elizabethtown" Sales Up</b>
The soundtrack to Cameron Crowe's latest film, "Elizabethtown," arrived in stores on September 13 &#8212; a whole month before moviegoers could watch Kirsten Dunst and Orlando Bloom fall in love after a chance encounter on an airplane. While sales of the disc were sluggish at first, interest in the soundtrack &#8212; featuring contributions from Nancy Wilson, Tom Petty, Elton John, Ryan Adams and My Morning Jacket &#8212; surged a whopping 377 percent, landing the album on <i>Billboard</i>'s top 200 for the first time &#8212; at #125. Last week more than 10,000 copies of the soundtrack were carried away from stores, up from 2,000 the week prior.

<title><![CDATA[Story Of The Year Are Done With Dying, Admit Their Debut Was Lame]]></title>

Dan Marsala's a straight-shooter &#8212; the kind of guy who tells it like it is, because you get the sense that really, he just doesn't care enough about the truth to bother with fabrications. Take his revelation this week that, in retrospect, his band Story of the Year's 2003 debut disc, <i>Page Avenue,</i> wasn't very good.
</p><p>"It started to get to all of us, especially when that first record got lumped in with all of these new bands coming out that aren't really that good &#8212; this time around, we wanted to make a real record and show people that we can actually play music," he explained. "Our first record wasn't really ... I don't know ... us. I mean ... it had no feeling at all. People still loved the record, and that's awesome. But we didn't want to do that again. We wanted to sound like a real band."
</p><p>Marsala lays a lot of the blame for <i>Page Avenue</i> &#8212; which has gone on to sell more than 783,000 copies in the U.S. &#8212; on its producer, Goldfinger's John Feldmann (Mest, the Used.)
</p><p>"We'd kind of all decided we didn't want to work with Feldmann again, because we wanted to go for a different sound on the second record," the frontman said. Instead, they recruited Steve Evetts (the Cure, Dillinger Escape Plan) to helm the forthcoming album, <i>In the Wake of Determination,</i> which hits stores on October 11. "He let us do what we wanted to do. He didn't change us. Feldmann had originally changed our sound. All of his records have the same sort of sound, because he's always using the same formulas on everything."
</p><p>So not only will Story of the Year fans finally get to hear the band for the first time on <i>Determination,</i> they'll hear a more mature, more energized group, Marsala said.
</p><p>"Everybody says 'We've matured' on the second record &#8212; but it really does sound like we went from being 18 to 19," he joked. "And, I mean, it's not easy to capture the live feel of a band. Usually, we don't sound the best live anyway. But what we wanted to catch was the energy of our live show, more than anything."
</p><p>Story of the Year also took a different approach to the lyrical attack on this effort.
</p><p>"The last album, we had a lot of songs about dying," Marsala said. "It was a recurring theme, but not on purpose. Drowning, stabbing &#8212; dying. There's not a whole lot of that on this record. It's a more positive record. I listened to a lot of old-school hardcore, to get that positive hardcore to get that positive hardcore feel, like Sick of It All, H20, Bane."
</p><p>This fall, Story of the Year will be touring the nation with Funeral for a Friend, Anberlin and He Is Legend as the trek's warm-up acts; the tour kicks off September 22 in Wichita, Kansas. It's around that same time that you should start seeing the first <i>Determination</i> video, which was shot at a Los Angeles soundstage for the lead-off track, "We Don't Care Anymore," with director Kevin Kerslake.
</p><p>Not much to the video, though, said Marsala. It's your basic performance-footage clip, only shot with cool lighting effects and special camera angles. The singer seems more excited about the album's artwork, which guitarist Ryan Phillips and bassist Adam Russell worked on together.
</p><p>"We had a few people try to come up with some ideas, but we're totally picky dudes," Marsala confessed. "Everything we got, it was like, 'Eh, I don't know.' For the first record, someone else did it, and we weren't happy with that. You know what? We're never happy with anything. We're just a bunch of a--holes and everybody should hate us."

<title><![CDATA[Story Of The Year Reveal The Story Behind Their 'Anthem']]></title>

<b>IRVINE, California</b> &#8212; Story of the Year have a confession to make about "Anthem of Our Dying Day," one of the summer's hottest rock tracks.
</p><p>"Well, it's not really about dying," guitarist Ryan Phillips admitted recently. "I wrote all the lyrics for that one. It was one of the few songs that [singer] Dan [Marsala] didn't write. And ... it's about ghosts."
</p><p>Story of the Year chose not to elaborate, but they had no problem explaining the band's next single, "Sidewalks," which is, of course, not about sidewalks.
</p><p>"We're all from St. Louis and we all moved out to L.A. to do the record and were out there for quite a while," guitarist Phillip Sneed said. "Eventually, it wasn't a planned theme, but the whole album kind of took on like a whole sentimental, missing-home type of vibe, and a lot of the songs, including 'Sidewalks,' are about missing home and missing friends and memories and stuff like that."
</p><p>"The town we lived in/ The memories shaken apart/ From the weeds that grow/ Over the sidewalks," Marsala sings on "Sidewalks."
</p><p>"It ended up being a big collection of metaphors, hopefully universal, so that people can put whatever they want to it," Sneed said. "We wanted it to just be an acoustic thing, we just kind of went at it at a really different attitude than all the other songs, and it ended up great. We had the opportunity to do some strings on it. ... It's my favorite song on the album because I'm a big pansy and I like that sort of stuff."
</p><p>Thus explains Story of the Year's decision to release it. "We get to show our sensitive side," Phillips said.
</p><p>"Sidewalks" will not hit radio and video outlets until the fall, after Story of the Year finish the Warped Tour (see <a href="/news/articles/1488759/20040629/new_found_glory.jhtml">"Warped Tour Launch Electrifies Without The Lightning"</a>) and begin headlining their own trek. The band also hopes to release a DVD later in the year, which Phillips and bassist Adam Russell are personally editing. "They've taken over the back lounge of the bus," Sneed said.
</p><p>Recording sessions for the follow-up to <i>Page Avenue,</i> which was released in September, will commence in January, likely with Goldfinger's John Feldmann producing again. Feldmann discovered Story of the Year when they were still known as Big Blue Monkey and playing around St. Louis.
</p><p>One thing the band won't be doing again is playing another show with Godsmack. After sharing a radio station festival bill with the group a month ago, Story of the Year were jumped by Godsmack's crew (see <a href="/news/articles/1488110/20040602/story_of_the_year.jhtml">"Story Of The Year Say Godsmack's Crew Kicked Their Asses"</a>).
</p><p>"Dude, the thing that's stupid about it is that it wasn't their show," Phillips said. "If it was their show and we did something to piss them off, whatever. But no one can say or do anything to change the fact that it wasn't their show and they're wrong. That's all we have to say."

<title><![CDATA[Warped Tour Launch Electrifies Without The Lightning]]></title>

<B>HOUSTON</B> &#8212; When the Vans Warped Tour rolled into the festival grounds adjacent to Reliant Stadium on Friday to unfurl punk rock's most enduring caravan, organizers wanted the kids to thrash, mosh and have fun. What they didn't want was for tongue, belly and nipple rings to get lit up by lightning.
</p><p>Friday was scheduled to be the opening date on the 10th-anniversary edition of the Warped Tour, but heavy storm forecasts persuaded tour founder Kevin Lyman to postpone the show until Monday. With a 60-plus band lineup that included current hitmakers New Found Glory, Story of the Year and Yellowcard as well as breakout new faces Coheed and Cambria and punk granddaddies the Vandals and Bad Religion, it was better to wait than subject the ticket-holding freaks, geeks and extreme music and sports junkies to possible electrocution and waterlogged toes.
</p><p>Eight hours of music spread across seven stages is only half the story. The Warped Tour is Punk-Rock Utopia for anyone with a jones for the grossness of the Jim Rose Circus or the adolescent humor of Blink-182.
</p><p>A walk through the compound is like having the coolest alternative record store spring to life. Tents boasting meet-and-greets with members of Taking Back Sunday stand side-by-side with kiosks offering skate wear, Flogging Molly swag, samplers from punk label Kung Fu Records and $3 lap dances from a pasty guy in a leopard thong. At one end of the grounds there are skate rats carving up a half-pipe. At the other end is the reverse daycare, an air-conditioned tent where parents sit watching "50 First Dates" with headphones on while trying to forget what lurks for their teenagers outside this fortress of solitude.
</p><p>Like the Alkaline Trio. The 30-minute set by the Chicago-born punk-popsters was punctuated by purring harmonies of Matt Skiba's guitars and vocals on "Private Eye" and "Maybe I'll Catch Fire," and ignited four hours of nonstop movement on the two main stages.
</p><p>The majesty of the Warped Tour is its ability to perpetuate its own momentum. When New Found Glory first appeared at the festival, they played the local music stage in Jacksonville, Florida. This year they are celebrating the success of their fourth album, <I>Catalyst,</I> and drew a large portion of the estimated 10,000 in attendance to their 30-minute set. The mix of guitarist Chad Gilbert's ever-building guitar dramas and the emotional warfare clotted in Jordan Pundik's vocals has not been lost on new songs "All Downhill From Here" and "Your Biggest Mistake." What keeps them just on the bright side of Dashboard Confessional-style mental torture are declarative sing-along favorites like "My Friends Over You."
</p><p>Remember the name Coheed and Cambria. With a parallel-universe thought process akin to Tool or Nine Inch Nails and guitar dexterity that traverses metal and prog-rock academics, they look promising as a future Warped headliner. C&C's Claudio Sanchez joins Jon Anderson of Yes and Geddy Lee of Rush as singers whose voices sound dependent on equal parts oxygen and helium. By the end of their set, Sanchez's high-pitched pining on "Blood Red Summer" and "Three Evils" was drawing applause with as much frequency and volume as Yellowcard enjoy every time Sean Mackin resins up his violin bow.
</p><p>After this emotional outpouring, the comic relief of veteran Southern California punk pranksters the Vandals couldn't have been more timely. Having reached year 23 in their career, they have been around longer than many of the other artists have been alive, but party odes like the twisted holiday carol "Oi to the World" and the mullet-tribute ditty "I've Got An Ape Drape" make them forever young.
</p><p>Come to think of it, a punk-rock Peter Pan complex just might keep the Vans Warped Tour going strong for another 10 years while other rock festivals, like the just-canceled Lollapalooza, continue to falter (see <a href="/news/articles/1488674/20040624/new_found_glory.jhtml">"Vans Warped Tour Turns 10 &#8212; So What's Its Secret?"</a>).

<title><![CDATA[Story Of The Year Say Godsmack's Crew Kicked Their Asses]]></title>

It's probably safe to say that Story of the Year will never again play on the same bill as Godsmack. On Tuesday, the main news piece on Story of the Year's Web site carried the headline "F--- Godsmack and their f---ing crew."
</p><p>The story, written by guitarist Ryan Phillips, detailed an incident at a May 29 radio festival in Noblesville, Indiana, in which Godsmack's road crew allegedly jumped and pummeled Story of the Year and their road manager.
</p><p>Photos of two of the bandmembers' bruised and bloodied faces were posted along with the piece, in which Phillips claims Godsmack's crew attacked the band because they were mad that Story of the Year singer Dan Marsala asked fans sitting on the lawn to come to the front of the stage and rock out.
</p><p>"We walked offstage excited because we turned a sh--ty show into a f---ing rock show," wrote Phillips. "Within 10 seconds of us finishing our last song, Godsmack's ugly d----faced production manager had his hands all over Dan, screaming at him, saying, 'Get the f--- out of here, you're not getting f---ing paid.' "
</p><p>In response, Marsala reportedly replied, "Who the f--- do you think you are? You're not f---ing rock stars. Yeah, rock and roll! Wahooooo."
</p><p>At that point, Story of the Year's tour manager allegedly told Godsmack's production manager not to touch the bandmembers. So, according to Phillips, "Three Cro-Magnon jock f---s grab our tour manager and hold him still so one guy could pummel his face. Four of them jump on [bassist] Adam [Russell] and pummel his face. Dan, [guitarist] Phil [Sneed] and I got hit, but not half as bad as they did."
</p><p>The only bandmember to escape the fracas was drummer Joshua Willis, who went into the dressing room moments before the fight. In his post, Phillips admitted that the members of Godsmack were not involved, but he added that they also weren't the least bit sympathetic. "Not one member of that f---ing band bothered to come and apologize for it," wrote Phillips. "[Singer] Sully [Erna] walked by our dressing room, looked at us, and gave us a dirty look. No 'Sorry my Hoosier-ass crew jumped you,' no 'Sorry my band hires irresponsible f---ing criminals.' Nothing."
</p><p>Godsmack's management didn't return phone calls, and the Clear Channel representative at the event had no comment.
</p><p>Phillips added that after the fight, police detained Story of the Year but let Godsmack's crew off. "We were held in a room, then held in our bus," Phillips fumed. "Then, the icing on the cake: An inbred cop with a handlebar mustache tells us he's 'not putting up with our kind,' and 'the whole thing's a joke' and he 'can personally guarantee that nothing will happen to anyone that kicked our ass.' "
</p><p>There were no arrests from the incident, and the Noblesville Police Department had no record of anything having taken place.
</p><p>Story of the Year's account of the fight has been removed and replaced with a note reading: "I took the Godsmack post down because we are going to ask them to go get some ice cream with us."
