September 18 [14:00 EDT] -- Robert Miles, who had an instrumental hit last year with the techno-lite track "Children," is now coming under fire for that very same track.

Onetime Frank Zappa keyboardist Patrick O'Hearn, who's been recording new age instrumental albums for more than a decade, claims that the Miles song rips off his own 1985 track "At First Light."

O'Hearn, who seeks more than $10 million in damages, believes his tune was stolen while Miles worked as a DJ in Italy in 1995.

Neither side had any further comment on the suit as we went to press.
