In 2004, the Monsters of Folk were in need of a new name. Seems their original handle didn't quite roll off the tongue the way they'd hoped.

"We used to have a really long name," MOF'er (and Bright Eyes main man) Conor Oberst laughed. "We were called 'An evening with Bright Eyes, Jim James and M. Ward.' It wasn't very catchy."

"So our road manager just started calling us the 'Monsters of Folk,' because each of our careers have been so storied on folk," fellow Monster (and My Morning Jacket frontman) Jim James added. "It really seemed to fit, especially since it didn't."

And thus, a supergroup was formed ... and not just any supergroup, mind you, but perhaps the most indie-riffic in history. Born after Oberst, James and She & Him's M. Ward joined forces for a brief run of dates in '04, the Monsters added multi-instrumentalist Mike Mogis to the mix and, over the next two years — in between making albums with their other bands — somehow also found time to work on a Monsters of Folk album too.

Sort of.

"A lot of procrastination went into this record," Oberst laughed. "You know, whenever we had time, we'd get into it."

"You know, people's schedules get busy, and we had to turn it from a pipe dream into a reality," James added. "And to do that, we had to commit to some time. Which we eventually did."

The result of those two years is the Monsters' self-titled debut (out September 22), 15 songs of sun-dappled, well-worn (sorta) folk tunes (plus the occasional bubble of electronics). Recorded in Malibu, California, and Oberst's hometown of Omaha, Nebraska, and produced by Mogis, it's an album that tackles topics like love, loss, religion and politics ... all filtered through the respective, reflective lenses of Oberst, James and Ward.

"Everyone came in with ideas and concepts that were then fleshed out by the group. We didn't write these songs specifically for our other bands, we just wrote them because we like writing," Oberst explained. "For me, specifically, I don't think about what I'm going to do with the song before it's written ... I don't really think of anything before it's written. It has to exist before I can ponder what to do with it. So I was writing for different records, and I just chose which ones felt like they'd work for this record."

So will there be another record? Or is this a one-time thing? No one in the Monsters seems to know, though — aside from a tour of North America and Europe in October and November, they've got nothing else on their schedule. That said, it'd be a shame if they let such a killer name go to waste ... especially one they fought so hard to get. Or, you know, something like that.

"There actually was a Monsters of Folk before this Monsters of Folk, and we were really upset because they stole the name from us before we even knew each other. They were on tour in, like, 1997, and we didn't start Monsters of Folk until 2003, but they shoulda known we were gonna get together," James said, a smile stretching across his face. "So we threatened to sic our lawyers on them, and all of a sudden they decided to let us use the name. Which was really cool of them."

Change is good, as the man Conor Oberst hopes to see in the White House, Barack Obama, reminds us. As for Oberst himself, he's never been big on staying in one place, either ... geographically or musically.

For more than a decade, as the leader of Bright Eyes, he's released a string of albums that have seen him torn and heartbroken over matters personal and political (Fevers and Mirrors, Lifted ...) and discovering New York, like a good young artist, before deciding he'd had enough (I'm Wide Awake, It's Morning). He's dipped a toe into electronics (Digital Ash in a Digital Urn), and last year, country rock (the Four Winds EP), lush strings and even a waltz or two (Cassadaga).

This year, change for Oberst came in the form of a makeshift recording space in a Mexican mountain villa, a patched-together group of musicians — most of whom he'd collaborated with in the past — dubbed the Mystic Valley Band, and a change of label, from longtime home Saddle Creek to Merge. The result is Conor's first solo album in 13 years, one that he is supporting with a tour that brings him and the Mystic Valley crew to the States in the coming weeks.

The new album, due officially August 5 but already leaked, is generally more subdued and certainly more stripped down than Cassadaga, and it wrestles thematically with some of the same ideas that the Bright Eyes record did, including the importance of adventure, exploration, loving life and living it one day at a time. Getting Oberst to talk in depth about the songs, though, was not so easy.

He is the pre-eminent American singer/songwriter of his generation, a guy who, though some may still dispute whether he deserves to be spoken of in the same breath as Guthrie and Dylan, certainly has earned his place alongside Elliott Smith, Jeff Tweedy,Jeff Buckley and, yes, even Bruce Springsteen himself. But when I met up with Conor earlier in the summer and told him we wanted to do a track-by-track commentary on the album, he gave me the sort of look I imagine I would get if I had said, "Mr. Oberst, I'm afraid we'll need to do a root canal." But he gamely suffered through my queries, and what follows are the best bits of our conversation — his thoughts on select tracks from Conor Oberst.

"Cape Canaveral"

John Norris: There are a lot of tracks that seem to be inspired by one location or another. Can you talk about that one and where it came from?

Conor Oberst: For me, even the songs that don't mention a specific geographical location, in my mind they usually take place somewhere, there's a setting to it. And for whatever reason, it finds its way into the songs a lot. That song is, I guess, more of nostalgia of watching rocket launches on TV, that kind of thing. I've never been to a rocket launch, unfortunately. I'd like to see one though.

"Sausalito"

Norris: "Sausalito," it's kind of like a driving song to me, a little bit of a road song. Any particular inspiration there?

Oberst: The Grateful Dead? I don't know. Yeah, it's definitely an escapist song. I think it makes a lot of sense, road trip ... [Sausalito] is a very beautiful place. As much as it sounds romantic to live on a boat, I don't think I would like it that much. I'm kind of a solid-ground person.

"Get-Well Cards"

Norris: I know probably the single word or name that you would do well without ever hearing again is Dylan. But on "Get-Well Cards," there are moments — because of this kind of spoken/sung thing you do there — where he's who comes to mind. Can you talk about that?

Oberst: That's fine with me. He spits fire, Dylan. So I like his music. "Get-Well Cards," that's actually kind of a beach-inspired song. Hanging out at the beach and kind of daydreaming. ... I guess it's kind of about forgiveness. That's the main gist of that one: forgiveness.

"I Don't Want to Die (In the Hospital)"

Oberst: I think it has a sort of comedic aspect to it. The juxtaposition of the music and what's being sung about I suppose. ... I just think of sort of a stubborn old cowboy man that just wants to go lay in the grass and, you know, die out by the tree or something.

"Eagle on a Pole"

Oberst: That song, there's actually a story behind it. We were on the bus one day and a friend of ours that travels with us and works for the band kind of came out from the back of the bus and said that first line: "Saw an eagle on a pole ... I think it was an eagle." And then this guy Simon Joyner, who is a great songwriter from Omaha and one of my great friends, he was on tour with us and sitting there and he was like, "You know, that's a great name for a song." We kind of had a contest where he wrote a song with that first line, and [then] I did, and a couple of our other friends. We kind of all played them for each other. Simon's is better than mine, but it is a good line to start a song.

"NYC — Gone, Gone"

Oberst: I think of it as a pseudo-spiritual song — stomping feet and clapping hands. I like that it's short too. I don't have many short songs, but I like that about it.

Norris: This is no big rift with New York?

Oberst: No. It is the idea of once you're here, it like ... seems like there's a lot of songs about getting here, then once you're here, [there's a] "Where do you go next?" kind of thing.

"Moab"

Oberst: Moab [Arizona] is an amazing town. ... I'd heard about it and then actually I just drove out there by myself on a whim in between things, and it's uh, yeah, it's ... I wanted to check it out. There's, like, this place, Arches National Park, out there, which has the big blown rock arches, and it's really amazing.

"Valle Mistico (Ruben's Song)"

Norris: "Valle Mistico" [where Conor recorded the album] essentially is an instrumental. It's a horn track. Who's playing on that?

Oberst: This guy Ruben, who worked at Valle Mistico. He used to blow this conch, like a seashell horn. So every night ... there was this mountain that was above the place and he would go up there and blow it and he was just ... we became really great friends with him. It was just a sound we were used to hearing. And you can really hear the sound of the night. 'Cause you blow it and it reverberates off the mountainside, and I just ... it's such a pleasant sound, I wanted to capture it.

"Souled Out!!!"

Oberst: This is a pun, and I don't typically like puns. But it was almost, like, too good to pass up. That's actually the one song that was written start to finish down there. Just kind of jamming. I'm very fond of the drum take in that song, 'cause it was the second time we'd ever played the song and we recorded it. That's always, I think, there's something fresh about it for that reason, because we didn't really know how it went when we recorded it.

"Milk Thistle"

Norris: What's the significance of the name "Milk Thistle"?

Oberst: That's a, you know, an herbal supplement you take for liver protection. That's where it comes from. ... It's, like, to promote liver health.

Norris: [The lyric] "If I go to heaven, I'll be bored as hell," is that sort of an ongoing thing of, like, not worrying about what happens next?

Oberst: Yeah, I guess the logical problem with the idea of heaven [is that] you can't really have infinite eternal goodness, 'cause you wouldn't understand it.

Norris: Well, the concepts of heaven and hell, aren't they just a way to keep us all behaving?

Oberst: I guess it depends on who you talk to.

How is a Conor Oberst solo album different from a Bright Eyes album?

Well, to begin with, there he is, right on the cover of his self-titled CD. That's a change. For more than a decade, Oberst has released Bright Eyes albums distinguished not only by great music but by beautiful artwork (see: Fevers and Mirrors, Lifted ..., Cassadaga) that bears no trace of the face of the musician himself. So it is momentarily jarring to see Oberst sacked out in a black-and-white photo, having what appears to be a post-nookie siesta in a hammock, while a rail-thin señorita sits by the fire behind him.

But apart from a CD cover, what's the difference between Bright Eyes and Oberst "solo"?

"I guess the main difference is that [multi-instrumentalist and producer] Mike Mogis didn't play on this record, and I didn't feel right calling it Bright Eyes without him playing on it," explained the artist, who over the years has also recorded with other bands including Desaparecidos, Commander Venus and Park Ave. But not in 13 years, since The Soundtrack to My Movie, has Oberst released a solo album.

Never mind that many have long perceived Bright Eyes to be creatively, in essence, a solo project — no more a "band" than, say, Beirut, Badly Drawn Boy or M83. Conor is quick to point that out as a misperception. "Bright Eyes is me and Mike and Nate [Walcott]. The idea of it being a solo project comes from a bio that was written after the first record in 1998 that, because of laziness, we never corrected. But, I mean, pretty much since Lifted ... time, which was, like, 2002, it's more or less been the three of us on virtually every tour and definitely every recording. In my mind, it turned into a band along the way."

That band's numbers swelled last year with the lush strings and backing girls of Cassadaga and its accompanying tour, on which the large onstage posse was decked head-to-toe in white. But once that ran its course, the ever-restless Oberst, who admittedly tends to do things in reaction to what came before, stripped things down, did a string of fall dates with a more back-to-basics rock lineup, and set to work on a batch of songs that he knew he did not want to record in a traditional studio.

"I was looking at places in the States, but then some friends that live in Cuernavaca, Mexico, found this, basically, little hotel with four little houses — kind of a villa setup."

It was called Valle Mistico — Mystic Valley — and so, the group of musicians with whom Conor decamped south of the border, including Andy LeMaster, Nik Freitas, Taylor Hollingsworth, Macey Taylor, Jason Boesel and Bright Eyes' Walcott, became known as the Mystic Valley Band.

"We couldn't have asked for a more relaxing environment to work in," Oberst told me when I met up with him in a Mexican restaurant (I am a master of the obvious) in New York. "It was beautiful every day, and we were outside of this little town called Tepoztlán, more up in the mountains."

Now that hammock starts to make sense. And that relaxed vibe of the recording process translates to the music on the album as well. It's quieter and more spare than his last release, at times even somber. There's "Eagle on a Pole," a pretty reflection on relationships and fidelity; the easy rocking standout "Danny Callahan," an ode to a sick little boy; and "NYC — Gone Gone," a just-over-a-minute Slade-like stomper that's a testament to Conor's desire to get outta town and head down Mexico way.

As much as anything, wanderlust seems to be the theme that continues on from Cassadaga. Where that record found Conor crossing the country, ending up — and hooking up — here and there, the new album sticks with that nomadic approach, with songs that take our hero from Utah ("Moab") to Florida ("Cape Canaveral") to California (the Deadhead-friendly "Sausalito"). The troubadour from smack-dab in the middle of the nation has never much cared for staying in one place.

"I honestly don't like being somewhere for more than a month or two," he said. "It's just ... I'm ready to go. For some reason whenever I go some place new, get a change of scenery, there's always a lot of optimism, and just that idea of turning over a new leaf."

While he has places in both Omaha and New York, he said neither one really constitutes "home," and roommates take care of the houses for him. Nor does being perpetually on the move make for ideal relationships: "I've been taking it a little easier on that front. I had a sort of off-and-on girlfriend for a long time," he said. In fact, it lasted six years but ended last summer: "It never really worked because of my lifestyle."

Another relationship that Conor has not so much terminated as taken leave from is his long-standing affiliation with O-town's Saddle Creek, releasing the new record on another indie stalwart, Merge — home to, among others, M. Ward, Wye Oak, She & Him and Spoon. Conor chalks that decision up to "stirring up the pot, trying something new," but he said not to make too much of it.

"I've done so many records with Saddle Creek, and obviously they're my great fans — there was no falling out or anything. I think I'll certainly work with them again."

But as with most things in his life, Oberst will cross that bridge when it appears on the horizon of the convertible that he's (literally or figuratively) driving from place to place, and he will likely try to keep living in the moment. That carpe diem spirit crept up time and again on his last album, and it's echoed on the new record's closer, "Milk Thistle." So why live so resolutely in the here and now?

"Well, that's all we have really. You can think back and you can try and peek into the future or what your idea of the future is, but this is all we have, you know? It's a gift. That's why it's called the 'present.' "

Conor Oberst and the Mystic Valley Band have begun a world tour that arrives in North America July 25, and the album will be in stores August 5. Visit Rhapsody.com for more information.

"We didn't want it to be a big announcement about 'everything's over except the Internet, the Internet's the future,' 'cause that's utter rubbish," Yorke said. "And it's really important to have an artifact as well, as they call it, an object." Yorke, in one of his first public comments about the decision to release In Rainbows under a pay-what-you-wish scheme, explained that Radiohead had a "moral justification in what we did in the sense that the majors and the big infrastructure of the music business has not addressed the way artists communicate directly with their fans. ... In fact, they seem to basically get in the way. Not only do they get in the way, but they take all the cash." He also denied reports that In Rainbows was downloaded more than 1.2 million times in its first week, but, in keeping with the band's silence on sales, would not confirm how many times it was actually downloaded. "It's total nonsense. ... We're the only people who know, and it feels wrong to say exactly what happened," he said. "But it's been a really nice surprise and we've done really well out of it." ...

The presidential race will bleed over into late-night TV on Wednesday night (January 2) when David Letterman chats up Democratic contender Senator Hillary Clinton and Jay Leno welcomes Republican candidate Mike Huckabee on the respective comeback episodes of their shows. Chingy will perform on "The Tonight Show With Jay Leno," while Lupe Fiasco will play on the "Late Show With David Letterman," with Robin Williams also appearing. Letterman struck a deal with the Writers Guild of America that will allow him to return to air with writers, but Huckabee and Chingy will be crossing the picket line with their appearances on Leno's show, as the writers' strike continues. ... "L.A." Reid, Denzel Washington, Steven Spielberg, Brett Ratner, Billy Joel and others partied Sunday on a private yacht owned by Microsoft co-founder Paul Allen, and Jon Bon Jovi and Robbie Robertson performed at the shindig, according to Fox News. ...

Staind's Aaron Lewis, along with members of Boston, Tesla, Stryper and other bands, will join host Dee Snider of Twisted Sister at the fifth anniversary Relief Fund Charity Concert, to be staged February 25 at Providence, Rhode Island's Dunkin' Donut Center. The event is being put on by the Station Family Fund, a group founded by survivors, family members and community members affected by the Station fire, the February 2003 nightclub tragedy that claimed 100 lives. Proceeds from the show will go to the survivors of the fire, many of whom did not qualify for Social Security benefits. ...

The lineup for Dave Mustaine's Gigantour 2008 has been revealed. The trek, to launch in mid-April and run through late May, will feature his band Megadeth, as well as In Flames, Children of Bodom, Job for a Cowboy and High on Fire. ... P.O.D. have set an April 8 release date for When Angels & Serpents Dance, the band's forthcoming LP. The record will feature a guest appearance by Suicidal Tendencies mainman Mike Muir. ... Former Limp Bizkit guitarist Wes Borland's band, Black Light Burns, have begun work on material for their second album, which is set for release in early 2009. Borland said in a statement that the new stuff is "a lot more guitar-heavy than it is synth-heavy. The feeling/tone is a little more fun and weird compared to the darkness of the first album." The effort follows the band's debut disc, last year's Cruel Melody. ... Hatebreed were forced to postpone the final concert in their Stillborn Fest series after guitarist Frank Novinec broke his ankle. No word yet on when they'll make up the gig, which was supposed to happen Sunday in Rochester, New York. ...

A lawyer who previously represented Death Row Records boss Marion "Suge" Knight in a $130 million lawsuit over ownership of the onetime gangsta-rap powerhouse is asking a judge to set that judgment aside. According to the Los Angeles Times, in a hearing set for Wednesday attorney Dermot Givens is asking that the judgment be voided because of what he claims is new evidence that the plaintiff, singer Lydia Harris, and her imprisoned drug-dealing husband, Michael, allegedly duped a Los Angeles judge into ruling against Knight. The motion contends that Harris hid from the court that she had filed for bankruptcy five years before suing Knight and that she never claimed an ownership stake in Death Row during that legal proceeding. The motion also alleges that recent sworn testimony by the couple shows that Michael Harris, an alleged crack kingpin, was the real party of interest in her lawsuit against Knight; Michael Harris sued Knight in 1996 claiming he helped finance Death Row, and was awarded a $300,000 out-of-court settlement. Lydia Harris filed a separate suit in 2002 claiming that she and Knight started the label together and that he cheated her out of millions in profits. ...

James Brown's final recordings have been caught up in the legal feud over the late rock legend's estate, according to The Associated Press. Brown recorded an album in Los Angeles in summer 2006, but courtroom disputes over who should get his music royalties are preventing the release of the tracks. More than 50-60 additional unreleased songs recorded by Brown are also reportedly in the archives. ... The Jersey Boys have a bit of a problem on their hands. Tommy DeVito, ex-bassist of Frankie Valli & the Four Seasons — on which the "Jersey Boys" story is based — is being sued by the widow of a man who also wrote a story about the group, according to TMZ. Donna Corbello says her late husband Rex Conrad Woodard's yet-unpublished book was the basis of the Broadway smash, and she is reportedly seeking a declaration that he is the volume's "joint owner" so she can get some of the future profits from the production. The suit was recently filed in a district court in Texas. ...

It's Hammer time all over again. MC Hammer is about to launch a new Web site that he hopes will rival YouTube as the online hub for sharing and watching dance videos, according to AP. He is the co-founder and chief strategy officer of DanceJam.com, which will go live later this month and profit from Internet advertising. Perhaps the site will reverse Hammer's hard luck — he filed for bankruptcy in 1996 with nearly $14 million in debts. ... Evan Farrell, an indie-rock bassist who played with the Magnolia Electric Co. on tour and, earlier this year, left the Rogue Wave fold, died the weekend of December 22-23 after sustaining injuries from a house fire in Oakland, California. He was 33. "He was a fixture in our community and a bright spot in all of our lives," Secretly Canadian, the label the Magnolia Electric Co. call home, said about Farrell in a statement. "He was exceptionally talented, funny and genuine."

With 55 days left in the year, here's your quintessential guide to new releases this week ...

The Top Five:

Jay-Z's American Gangster: Like Roger Clemens, Jay keeps coming back out of retirement so he can play again — and he decides on his own watch when it's best to do so. While it's not officially connected with the film of the same name, his perfectly timed American Gangster is sure to enjoy some of the runoff from the film's marketing — did you forget that Jay is a businessman? For proof of how much the music mogul's LP has already been talked about, look no further than Jim Jones, who has already put together a mixtape in response, Harlem's American Gangsta. Jay's sweetheart, Beyoncé, joins him on the concept album, as do Diddy, Lil Wayne, Kanye West, Pharrell, Beanie Sigel, Jermaine Dupri, Bilal, Nas and more.

Chris Brown's Exclusive: Like Jay, fast-rising R&B singer Brown has also been doubling up on publicity — while his new album drops this week, he's going to be chasing it with the November 21 flick "This Christmas." "I am still going to keep it so my younger fans can continue to listen to my music, but I got a couple of joints on there that's for some of the older people," he previously told MTV News of his intentions for the album. And while that supposed Michael Jackson collaboration didn't make it onto the disc, Lil Wayne, Game, Big Boi, Will.I.Am and T-Pain are on the guest list, with Swizz Beatz, Dre & Vidal, Scott Storch and others lending their production talents too. Don't miss the limited-edition version, which also contains a DVD.

Cassidy's B.A.R.S.: The Barry Adrian Reese Story: "It's called B.A.R.S. 'cause I was locked behind bars, I was known for spittin' bars and Barry Adrian Reese is my biological name, so I just felt like it was the perfect title," the rapper recently told MTV News about his new release. Cass already has a club monster on his hands in "My Drink N' My 2 Step" — adding to the album hype, a remix of the track featuring Kanye West, Ne-Yo and Swizz Beatz has also already slipped out, as has the second single, "Innocent Man" (featuring Mark Morrison). John Legend also plays a role on the album, as a guest star on "Celebration."

Angels & Airwaves' I-Empire: That's a lot of hip-hop weight for one week, but repping the rock front is Tom DeLonge's band, which is putting out its second album this week. With an album cover resembling some '80s space movie for kids and a title that already feels outdated, but as DeLonge insisted to MTV News, the band has a "grand vision." A&A fans might want to head over to Best Buy to pick up the package — the version the retail chain is selling has bonus acoustic versions of "Do It for Me Now" and "Everything's Magic."

Bright Eyes' Motion Sickness: Live Recordings: The lauded folk-rock group has issued every one of its releases through Saddle Creek, an indie label out of Omaha, Nebraska, that owes its very existence to the band. But Conor Oberst decided to release their new concert effort on the Team Love label he co-founded in 2003. The 15-track CD — the sixth one Team Love has put out so far — overviews Bright Eyes' early-2005 tours in support of I'm Wide Awake, It's Morning and features a pair of noteworthy cover songs, of Feist's "Mushaboom" and Elliott Smith's "The Biggest Lie."

Five Face-Offs:

Nas and Nazareth: The rapper's controversial new album is still more than a month away, but fans can whet their appetite this week with Greatest Hits, which has two new tracks: "Less Than an Hour," the theme to "Rush Hour 3"; and "Surviving the Times," which features Cee-Lo. But while Nas is going to have to elbow past Jay-Z and Cassidy this week, he should beware another opponent who isn't a rapper: cheesy hard-rock vets Nazareth, whose Hair of the Dog - Live album is getting reissued this week in remastered form.

Ashley Tisdale and the Who: If you never see Nas and Nazareth mentioned in the same sentence, try this one on for size: both the "High School Musical" star and the classic-rock vets are telling tales this week. "There's Something About Ashley: The Story of Headstrong" traces Tisdale's growth from when the writing process for her debut album began through its release and her subsequent tour with the "HSM" gang. "Amazing Journey: The Story of The Who" follows the band throughout its entire career and features interviews with not just the bandmembers but with fans U2, Eddie Vedder and others as well. Fittingly, the Who's two-DVD set runs just slightly longer than Tisdale's: It's 237 minutes long, while hers is roughly an hour.

Ricky Martin and Imani Coppola: Ricky Martin has an interesting strategy this week. He's putting out three versions of his Live: Black & White Tour concert set — a CD, a DVD and a combined CD-plus-DVD package — and yet, according to the Sony Music store, the standalone DVD actually retails for four bucks more than the CD-plus-DVD edition. Curiously, singer/violinist Imani Coppola drops The Black & White Album this week via Mike Patton's Ipecac label (she toured with his Peeping Tom collective). And, believe it or not, the Hives' Black and White Album drops next week.

Demon Hunter and Monster Magnet: One heavy-rock band is battling evil creatures this week while the other is attracting them. Storm the Gates of Hell, the fourth album by Christian metal band Demon Hunter, features a DVD and two bonus tracks on select editions — "No Reason to Exist" and "Grand Finale" — while MM's 4-Way Diablo has 13 doses of slabby goodness.

Kasper Bjørke and Kim Hiorthøy: Two artists with strokes in their names releasing albums the same week? Who woulda thunk it?

Song Title of the Week:

"Candy Sun Smiles" from Oh Astro's Champions of Wonder

Album Cover of the Week:

Kasper Bjørke's In Gumbo

Looks like there's finally some good news for Britney Spears. The singer has been passing her court-ordered random drug tests and has a 50/50 chance of regaining custody of her children, her lawyer Sorrell Trope told People. Also, while Spears has lots of court dates to keep track of these days, she has one less for her calendar this week — her arraignment on misdemeanor driving charges (for hit and run, causing property damage and driving without a valid California license). Though her arraignment was scheduled for Wednesday, a Los Angeles judge decided Tuesday (October 9) that Spears could have until October 25 to enter a plea. The judge also ordered the singer to be booked by police and show proof of that booking by her arraignment, according to a court clerk. Spears' next hearing in her custody case will be the following day, on October 26. ...

Kiefer Sutherland will serve 30 days in Los Angeles County Jail as part of a plea deal in his DUI arrest, The Associated Press reports. He must also enroll in an 18-month alcohol-education class and go to weekly alcohol-therapy sessions for six months. On Tuesday, Sutherland's attorney Blair Berk entered a no-contest plea on the actor's behalf for driving with a blood-alcohol level over the legal limit, though a second misdemeanor DUI charge was dropped. The actor was most recently arrested for driving under the influence in Los Angeles in September — he was already on probation for a DUI arrest stemming from 2004. He will be sentenced December 21. ...

And on the soul/R&B front, Akon, Ne-Yo and T-Pain are up for Favorite Male Artist; Beyoncé, Fantasia and Rihanna are squaring off for Favorite Female Artist; Beyoncé's B'Day, R.

Rehab was a "sobering" experience for Lindsay Lohan, she told In Touch in her first interview since leaving Utah's Cirque Lodge Treatment Center on Friday. The actress also insisted that while she went to the clubs right after finishing a rehab stint in July, she's not going to be rekindling her nightlife anytime soon — to avoid distractions, she'll be staying in Utah until she starts shooting the upcoming flick "Dare to Love Me." "Going out all the time was very self-destructive," she said. "Partying and having all of those pictures taken distracts from the work that I do. It's not why I started acting. I didn't get into acting to be written about. ... I want to act like a woman rather than a teenager. I am doing the best I can." Lohan also opened up about seeing her estranged father for the first time in more than three years, while at Cirque Lodge. "It was really good for me ... it was really important for me to get a connection back with my dad, because I hadn't had that in a while." And if you heard those rumors about Lohan developing a relationship with a man while in rehab ... well, apparently they were true. "Yes, I am seeing someone," she confirmed. "His name is Riley. I am really happy and taking it day by day." The Riley in question is Riley Giles, a 25-year-old snowboarder from California. She announced the decision on her MySpace page, explaining that her lawyer's appeal will take issue with the jury's decision that making songs available online violates copyright laws.

Mariah Carey has a suggestion for troubled young female celebs: Find your center. When asked by Glamour what words of advice she would give Lindsay Lohan and Britney Spears, she replied, "I wouldn't want to speak to those people specifically, but I would say you need to be very centered, and spiritually know where you're at, all the time. It's not a financial struggle, but I'm still struggling in a lot of ways." Carey graces the cover of the magazine's November issue. ...

Diddy has had a tumultuous few days — first he was sued by a former associate who claimed the hip-hop mogul owes him $19 million for work by the Notorious B.I.G., and then he accepted legal responsibility for his sixth child, The Associated Press reports. In the suit, James Sabatino claims he flew the late rapper to Miami in 1994 to play a gig and hit the studio — he recorded a 17-minute freestyle session, and 90 minutes of Biggie video was allegedly captured on video as well. Since Sabatino paid for the travel expenses and studio time, he says it was understood that the music and video belonged to him, even though a contract was never signed. Diddy claims the delay was due to Los Angeles police naming Sabatino as a person of interest in Biggie's death and that it might be misconstrued if people discovered Bad Boy had paid Sabatino. The ex-associate was later imprisoned on unrelated charges but continued trying to get the money from Diddy and was told it would be coming soon, the suit alleges. Sabatino is seeking $19 million for actual and punitive damages. While that dilemma recently emerged, Diddy put another one to rest when he took legal responsibility for his 15-month-old daughter, Chance — who is said to have factored into his split with ex-girlfriend Kim Porter. Diddy previously denied he had fathered the child of an Atlanta woman, Sarah Chapman, but has acknowledged that DNA tests have confirmed that he is the father. Diddy has arranged support terms and visitation over his daughter with Chapman. ...

The effort will also include a 12-page reproduction of Syd Barrett's notebook. ... Notorious ex-David Bowie manager Tony Defries will release his autobiography, Gods and Gangsters, in 2008. Also known for his work with the Beatles and Stevie Wonder, Defries is best remembered for helping to fashion the string of iconic characters rolled out by Bowie in the 1970s, as well as helping launch the solo careers of Iggy Pop, Lou Reed, Luther Vandross and John Mellencamp. ... The world's leading record label, Universal Music Group, has announced that it will experiment with offering a large part of its catalog for download without copy protection at least through January. According to The New York Times, Universal (home to 50 Cent, Amy Winehouse and Akon) will offer the songs without DRM through RealNetworks, Wal-Mart, Amazon.com, Google and some artists' sites — but not on top download service iTunes.

Gwyneth Paltrow wasn't so into the initial idea of singing onstage last year with Jay-Z at London's Royal Albert Hall, she admitted to W magazine for its September issue. "Jay was playing at the Albert Hall on my birthday, and he said, 'Will you sing on this song?' " the actress told the mag. "At first I didn't want to do it!" Paltrow also talked a little about her husband, Coldplay frontman Chris Martin, who was also onstage for the strange collabo. "When Chris gets home, we're not going to do anything other than what any regular couple does," she said. ...

A day after Amy Winehouse canceled two European festival dates following a trip to a London hospital to deal with what her label termed "severe exhaustion," a spokesperson for the singer said doctors have ordered Winehouse to rest in bed. For now, she's still expected to perform at the Virgin Festival in Toronto on September 8 as well as a string of U.S. dates in September. Winehouse's spokesperson would not comment on British tabloid reports that said the collapse that lead to the singer's hospitalization was possibly drug-related. ...

A woman is peeved that no one from Britney Spears' camp has contacted the woman about her car, which the singer was seen driving into earlier this week in Studio City, California. Kim Robard-Rifkin told CelebTV.com on Wednesday that, "It was simply like my car didn't matter to her, my inconvenience didn't matter to her." Robard-Rifkin, who filed a police report Thursday (August 9), added, "I'm not asking for money. I'm not asking for a new car. ... I simply want my car fixed, the same as I would fix somebody's car if I had done that." ...

Hilary Duff is branching out. The singer/actress has partnered with Michaels stores for Stuff by Hilary Duff, a new fashion-crafts line that includes bracelets, necklaces, charms, patches and more. All Michaels stores will host in-store demonstrations of the products on August 26 from 1-3 p.m. local time. ... An "American Idol" hopeful went into labor during her audition on Monday at Texas Stadium and had contractions as she was singing, People reports. After that, Antoria Gillon, who was taken to a local hospital, gave birth to a healthy son. She will be on the next round of the show. ...

John Mayer has been confirmed for the upcoming season of "Austin City Limits," Pitchfork reports — but the program will be heavily weighed toward indie-rock acts too. Bloc Party, Arcade Fire, Decemberists, Regina Spektor and Wilco have also been booked for the PBS series, which will start airing in October. ... The lineup for the first-ever Monolith Music Festival, to be held September 14-15 at Denver's historic Red Rock Amphitheatre, will include the Flaming Lips, Kings of Leon, the Decemberists, Editors, Black Rebel Motorcycle Club, Spoon, Cake, Clap Your Hands Say Yeah, the Brian Jonestown Massacre, Das EFX and many more acts. ...

Thrice have pegged October 16 as the release date for The Alchemy Index: Vols. I & II - Fire & Water, the first two parts of a four-volume concept effort. The other two chapters, Vols. III & IV - Earth & Air, will be released in the spring. Both sets will be issue by Vagrant, the new label the band calls home after parting ways with Island in June. Earlier this year, frontman Dustin Kensrue called the Alchemy project "daunting" in an interview with MTV News. ... If you've been exchanging MySpace messages with Chris Cornell in recent weeks, chances are you were dealing with an imposter. The real Cornell logged onto his MySpace page on Wednesday to clear up matters. "Over the past several months, several incidents have taken place where others felt the need to engage in activities pretending to be me," he wrote. "I have been wanting to make a clear statement to fans, friends and anyone this may concern." He added the confounding remark, "Under no circumstances, under any name or address, do I or have I ever communicated or corresponded with anyone online or otherwise." ...

Want to get up close and personal with Velvet Revolver? You can get your chance for $250, thanks to meet-and-greet packages being offered for the hard-rock group's Tuesday gig at the Tweeter Center in Mansfield, Massachusetts. The package includes a VIP laminate, personal photograph with the band, exclusive 8x10 color poster and autograph. ... Three unaired Alice in Chains performances taped during the band's "Unplugged" session in April 1996 are being unearthed for a revitalized version of the package, Billboard.com reports. The new Unplugged will drop September 18 and feature a bonus DVD boasting "Angry Chair," "Frogs" and "The Killer Is Me." ...

Expect to catch an eyeful of U2 rehearsing songs from their new album in "Here It Is," a documentary about the band's longtime producer Daniel Lanois that is set to debut at the Toronto International Film Festival in September, RollingStone.com reports. The feature film captures Lanois and the band in a studio in Morocco, with Billy Bob Thornton, Willie Nelson and others making guest appearances. ... Ricky Martin wants to start creating "a family of many colors" this year by adopting "one [child] from each continent," the singer told reporters Wednesday in his Puerto Rico homeland. The 35-year-old Martin is not married. ...

A fifth woman will be allowed to testify that Phil Spector threatened her with a gun, the judge in the music producer's trial ruled Wednesday, the Los Angeles Times reports. Former Spector employee and girlfriend Devra Robitaille was expected to testify Thursday after jurors returned from a tour of Spector's mansion in Alhambra, California, where he allegedly killed actress Lana Clarkson. The defense — which on Wednesday called to the stand a neuropathologist who said the way Clarkson's body was found was consistent with a suicide — objected strongly to the decision to let Robitaille testify.

Well, it took them long enough.

More than six years into the presidency of arguably the most polarizing leader in U.S. history, and four grindingly long years into the second-least-popular American war ever, a wave of musicians is finally speaking — or at least singing — up.

How quiet they had been. With few exceptions — the Dixie Chicks' refusal to "shut up and sing" in 2003 and willingness to pay for it by losing their largely red-state fan base, and Green Day's tour de force American Idiot, which was either about a disaffected teen or man in the White House operating with messianic purpose — the music community had been largely silent about George W. Bush, effectively giving the president and his policies — including the Iraq War — a pop pass.

Of course, without a concerted mass protest movement against the war, the rise of any significant amount of protest music was never likely. And where was it gonna come from? Certainly not pop or R&B. Hip-hop? The genre seems to have drifted from the voice that Public Enemy's Chuck D once called the "CNN of the streets."

So that left the old standby: rock. Today, it's as fractured and as embattled as it's ever been, and it hasn't been given to political commentary. The emo dudes (the Wentzes and Ways of the world) can summon plenty of angst, but generally don't look past their own navels to the wider world; so-called "mainstream rock" (Nickelback, the Fray, the Chili Peppers, etc.) didn't seem to be interested; the U.K.'s arena men (Coldplay, Snow Patrol, etc.) served more as musical balms than rabble rousers; and as erudite as many of them are, indie rockers were mostly addressing other concerns — definitely not the war or its architects.

Well, no more! At least not judging by the flurry of albums that have come out in the first half of 2007. From Arcade Fire, Sum 41, Bright Eyes, Smashing Pumpkins ... the voices and the lyrics — some literal and pointed, some far more subtle — run the gamut, but the overall message seems clear, and it ain't pretty.

"I think it's great for anyone to become more aware of those ideas and, if they're compelled to, share them with their audience," Bright Eyes' Conor Oberst said.

(See why Conor Oberst has been outspoken about the Iraq war, President Bush and more, right here.)

And yes, they are sharing. From Arcade Fire's "Intervention" ("No place to hide/ You were fighting as a soldier on their side/ You're still a soldier in your mind/ Though nothing's on the line") to Rufus Wainwright's searing "Going to Town" ("You took advantage of a world that loved you well/ I'm going to a town that has already been burned down/ I'm so tired of you, America") to Sum 41's remarkably blunt "March of the Dogs" ("Ladies and gentlemen of the underclass/ The President of the United States of America/Is dead!"), tongues have been unleashed up and down your radio dial (or all over your iTunes — pick your poison). The lyrics seem to echo a growing majority of public opinion, but while the origin seems clear, the timing — and why it all took so long — is a bit harder to pin down.

"Not many bands today are speaking their minds on issues", Linkin Park frontman Chester Bennington told MTV News. "We've been noticing some things that we're not too stoked on and we feel like we're at a place now where we can speak out about it."

Some artists say they've been speaking their minds all along, but the message may have been lost until now. "As for me, I felt really, extremely angry and frightened and crazy over it a few years ago," Oberst said. "I think that's when I was writing the most overt songs about it. Now I've sort of reached a point of overload, where I just didn't want to think about it anymore, which I guess is sort of chicken sh--."

Perhaps. Even Sum frontman Deryck Whibley backpedaled on the "the President of the United States of America is dead" thing, telling MTV News' James Montgomery that the lyrics are "a metaphor" for how "ineffectual and incompetent" Bush is as a president. Whibley also insisted the upcoming Sum 41 album Underclass Hero would not be a "political record" (see "Sum 41 Kill President In New Song — Deryck Whibley Says It's 'A Metaphor' s").

But if Whibley won't go there, plenty of others have. You'd be hard pressed to find a more "political record" than Year Zero from Nine Inch Nails. Trent Reznor traded in angst for social commentary, drumming up a bleak look at where America is — and, sadly, where it could be 15 years from now. You'd be hard pressed to find a darker record out there. "I got my propaganda/ I got revisionism/ I got my violence/ In hi-def ultra-realism/ All a part of this great nation/ I got my fist/ I got my plan/ I got survivalism," he howls on "Survivalism." Later, on "Capital G," he sings, "Well I used to stand for something/ Now I'm on my hands and knees/ Turning in the god of this war/ And he signs his name with a capital G" (see "Nine Inch Nails' Year Zero Preview: Beginning To Solve The Mystery").

The man who "signs his name with a capital G" also takes some knocks from a less expected place than Reznor: some former purveyors of nu-metal who've found a newly political voice. Linkin Park have never been viewed as a political band, but on the Mike Shinoda-penned track "Hands Held High," the band definitely goes there (see "Linkin Park's Minutes To Midnight Preview: Nu-Metallers Grow Up" and "Could Linkin Park, Green Day, Nine Inch Nails Be The Next U2?"). "For a leader so nervous in an obvious way/ Stuttering and mumbling for nightly news to replay/And the rest of the world watching at the end of the day/ In the living room, laughing, like, 'What did he say?' " Elsewhere on their latest, Minutes to Midnight, the band remembers the victims of Hurricane Katrina and takes aim at the government that failed to help ("Hope decays, generations disappear/ Washed away, as a nation simply stares").

At the same time, Bennington adds, the band will only go so far: observation, yes; incitement, no. "That was a difficult process with these particular songs because ... we don't want to preach, you know?" he said. "We just want to kind of speak our minds without telling you what to do." But there is no mistaking the origin of Linkin Park's new album title. Minutes to Midnight is a reference to the Doomsday Clock, the theoretical clock that portends the possibility of nuclear armageddon. (That clock, by the way, is currently "set" at five minutes to midnight).

And they aren't the only ones watching the clock. Smashing Pumpkins finally returns to us with the appropriately titled "Doomsday Clock" ("Is everyone afraid? Is everyone ashamed?/ Apocalyptic scream, they're bound to kill us all"). Main Pumpkin Bill Corgan isn't doing interviews for the upcoming Zeitgeist, preferring to let the music "speak for itself," we're told, and with tracks like "For God and Country" and the 10-minute epic "United States" ("I don't know what I believe/ But if I feel safe, what do I need?/ Revolution! Revolution!"), the music is speaking loud and clear.

The parade doesn't end there. Montreal's Arcade Fire returned in March with another album full of urgent, exuberant rock — only this time, as the twisted title Neon Bible suggests — they took their megaphones in a darker direction, one more informed by that uniquely American place where God, guns and gall intersect ("Don't wanna live in my father's house no more/ Don't wanna fight in a holy war/ Don't want the salesmen knocking at my door/ I don't wanna live in America no more," the band sings on "Windowsill").

And, of course, there is Bright Eyes. Oberst has been raising his voice and growing more politically indignant (about the state of the world and particularly about the Bush administration) since 2000 (see "Bright Eyes Slam 'Off-The-Leash Administration'; Give Details On New Albums"). He drew praise — and a degree of outrage — when he performed the vitriolic "When the President Talks to God" on "The Tonight Show with Jay Leno" in 2005 (moral of the story: know your audience). He tells us that his latest, Cassadaga, is less "overtly political," saying its essence is "just sort of trying to make peace with everything, to be comfortable in your own skin."

Still, there are undoubtedly political themes throughout. He concedes politics is "always in the background" and "hard to escape completely." And Oberst does manage to come
up with at least one incendiary couplet on "Four Winds": "The Bible's blind, the Torah's deaf, the Koran's mute/ If you burned them all together, you'd get close to the truth."

Them's fatwa words, son. Was Oberst not at all hesitant to go there, in a world where a cartoonist can be a marked man for offending religious sensibilities? Apparently not. "I guess I didn't think about it too much," he said. "I haven't really gotten much angry feedback or anything." And, while he says he means no disrespect to anyone's faith, he makes no apologies for the lyric. "For me, religion is ... if it enhances your life and it's something that, you know, gives you compassion or comfort or makes you empathetic toward other people or anything which religion should do in its pure form, then I think it's great. But it's hard not to look historically and just not think that it is the worst thing to ever happen to the human race. It really is."

Amid all of this, we also get the return of Rage Against the Machine, hardly a coincidence. But where were they during most of Bush's time in office? Squabbling? Not speaking to each other, when their powerful voice of dissent would seem to be just what the times called for? For that matter, where was anyone in music who thought this country was headed in the wrong direction? Clearly, Rage hopes to make up for lost time, telling the crowd at Coachella, "Our current administration needs to be tried, hung and shot. We need to treat them like the war criminals they are" (see "Rage Against The Machine's Ferocious Reunion Caps Coachella's Final Night").

Alrighty then. But will it any of this incite revolution? Not likely. This remains a nation of CD burners, not flag burners. As for Iraq, "surge" or no "surge," there is no end in sight. As the Florida punk rockers Against Me! point out in "White People for Peace" — a new song that the band says celebrates the nobility and futility of protesting war — "protest songs in a response to military aggression/ Protest songs to try and stop the soldier's gun/ But the battle raged on."

But neither is there any reason to think the protest lyrics will let up any time soon. You'd hate to think these artists simply waited until public opinion — in opposition to the war and to the Bush presidency in general — was overwhelmingly on their side. Whatever the reason, the flood gates seem to have opened. Better late than never, I guess. The march of the dogs as the doomsday clock counts down the minutes to midnight and year zero, and it's kill or be killed. It's coming, so keep the car runnin'.

Zeitgeist, indeed.
