"CRUNK-IT-UP HUSTLE & FLOW IPOD PHOTO SWEEPSTAKES"
OFFICIAL RULES
1. NO PURCHASE NECESSARY TO ENTER OR WIN A PRIZE. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
2. Entry Period: The "Crunk-It-Up Hustle & Flow Ipod Photo Sweepstakes" (the contest) commences at 12:00 a.m. (EST) on June 27, 2005 and ends at 12:00 a.m. (EST) on July 15, 2005. All entries must be received by 12:00 a.m. (EST) on July 15, 2005.
3. Eligibility: The Contest is open to legal residents of the continental United States, who are at least 18 years of age at time of entry. VOID IN HAWAII, ALASKA AND WHEREVER PROHIBITED OR RESTRICTED BY LAW. Employees (and the members of their households or immediate families (i.e., their spouses, parents, siblings and children and each of their respective spouses) of Viacom International Inc. ("Viacom"), the sponsor, MTV Networks (""MTVN" or "Sponsor"), Paramount Pictures, Inc. ("Paramount" ), and each of their respective corporate parents, subsidiaries and affiliated companies and entities, including their divisions, and advertising agencies, and anyone who has won an MTVN Contest or Sweepstakes in the 2005 calendar year, are not eligible. By participating in this Contest, entrants acknowledge compliance with these official rules ("Official Rules) and agree to be bound by them, by MTVN's interpretation of them and by the decisions of MTVN, which are final in all matters relating to this Contest.
4. To Enter: The Contest will be posted on MTV.com (the "Web Site"), a web site owned and controlled by MTV Networks, starting at or around 12:00 a.m. (EST) on June 27, 2005 and ending at or around 12:00 a.m. (EST) on July 15, 2005. Participants must complete all required fields on the online contest entry form and submit such entry form in accordance with the online instructions. Entries submitted in accordance with those Official Rules shall be hereinafter referred to as the "Eligible Entries." From the Eligible Entries, five (5) Grand Prize Winners ("Grand Prize Winner(s)")will be selected. Limit one (1) entry per person. If an entrant uses multiple e-mail addresses to submit more than one (1) entry, only the first online entry will count. Limit one (1) prize per person. All entries and entry materials become the property of MTVN.
5. Prize: Five (5) Grand Prizes ("Grand Prize(s)") will be awarded. Grand Prize consists of a customized "Hustle & Flow" Ipod Photo music player and fifteen (15) music CD's provided by Atlantic Records. The total approximate retail value (the "ARV") of the Grand Prizes is $2,500. No substitution of the Grand Prize or any portion thereof permitted, except by MTVN in which case a prize of equal or greater value may be awarded. The ARV for the Grand Prize is subject to change based on current market conditions at time of prize fulfillment.
6. Winner Selection and Notification: The potential Grand Prize Winners will be selected in a random drawing on or about July 15, 2005 from among all Eligible Entries received and will be notified by telephone. MTVN will make a minimum of two (2) attempts to contact the potential Grand Prize Winners during the forty-eight (48) hour period following selection of the potential Grand Prize Winners. If the potential Grand Prize Winners cannot be reached during the forty-eight (48) hours during which MTVN attempts to contact the potential Grand Prize Winners (no messages will be left on answering machines or voicemail systems), such potential Grand Prize Winner will be disqualified and an alternate Grand Prize Winner will be selected from among all of the remaining Eligible Entries received in MTVN's sole discretion. The odds of winning depend upon the number of eligible entries received.
7. Grand Prize Winner Verification: As a condition of receiving the Grand Prize, the Grand Prize Winners (or his/her parent or legal guardian if the winner is a minor in his/her jurisdiction of primary residence) must sign and return, within forty-eight (48) hours of receipt, (i) an affidavit of eligibility and liability release and hold harmless MTVN, Viacom, Paramount and their corporate parents, subsidiaries, affiliated companies and entities, including their divisions and advertising agencies, and the officers, shareholders, directors, employees, agents and representatives of each of them from and against any and all liability, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Contest or the use or acceptance of the Grand Prize, and (ii) except where prohibited, a promotional release granting the right to use his or her name, likeness, voice, and all entry materials for advertising, publicity and other commercial purposes, without additional compensation. Entry into this Contest constitutes Grand Prize Winner's agreement to sign such releases. Grand Prize Winner must also complete any additional legal documents provided by MTVN with respect to the Grand Prize and return them to MTVN within seven (7) days after receipt of such documents. Noncompliance may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY GRAND PRIZE WINNER (AT MTVN's SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS A GRAND PRIZE WINNER OF PARAMOUNT PICTURES' AND MTV'S "CRUNK-IT-UP HUSTLE & FLOW IPOD PHOTO SWEEPSTAKES" AND ALL ASSOCIATED PRIVILEGES WILL BE IMMEDIATELY TERMINATED. IN SUCH EVENT, AN ALTERNATE WINNER MAY BE SELECTED IN A RANDOM DRAWING FROM AMONG ALL OF THE REMAINING ELIGIBLE ENTRIES RECEIVED IN MTVN's SOLE DISCRETION. Upon receipt of the Grand Prize, Grand Prize Winner is required to comply with any and all applicable federal, state and local laws, rules and regulations. All taxes on the prizes as well as any expenses which are not expressly described herein are solely the Grand Prize Winner's responsibility.
8. General Terms: MTVN and Paramount assume no responsibility for incorrect or inaccurate entry information whether caused by a participant or by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the entries in this Contest. MTVN and Paramount are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, networks, servers or providers, computer equipment, software, failure of email or media on account of technical problems or traffic congestion on the Internet or at the Web Site, any other web site, or any combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Contest. If, for any reason, the Contest is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of MTVN that in its judgment corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, MTVN and Paramount reserve the right in their sole and unequivocal discretion to cancel, terminate, modify or suspend the Contest and/or prizes. In such event, MTVN may award the Grand Prize by a random drawing from among all remaining Eligible Entries received prior to the action so taken. Entries that have been tampered with or altered are void. In the event of a dispute over who submitted a winning entry online, the authorized account holder of the winning e-mail account will be declared the winner. An authorized account holder is defined as the person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. MTVN reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web site; to be acting in violation of the Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, MTVN AND PARAMOUNT RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT/INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE NEW YORK COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE CONTEST AND THE LAWS OF THE STATE OF NEW YORK SHALL GOVERN THE CONTEST. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.
